Personal Injury
Refers to the area of law that seeks to protect individuals who are wrongly harmed by the negligence or tortious behavior of another person. Negligence is defined as the failure to act with the prudence that a reasonable person, under the same circumstances, would have exercised. What often occurs is a defendant’s conduct imposes an unreasonable risk upon another, which results in personal injury or wrongful death. Every person has a legal duty, which requires that he or she behave in society according to a certain standard, so as to not subject others to unreasonable risks. If someone breaches this duty and causes injury or death to another person or their property, he or she may be liable for any damages caused.
